Earnr helps you summarise your capital position and performance, learn about financial markets, and access fixed income financial products.
In these Terms ("Earnr", "us", "we", "our") mean Earnr Australia Pty Ltd and related entities; ("you", "your", "their") means any individual, group of individuals, sole trader, partnership, company, superannuation fund, or trust.
These Terms & Conditions ("Terms") form a binding agreement between you and Earnr in relation to all interactions, products and services involving Earnr; and govern your use of all websites and applications located on the domain earnr.com.au (including sub domains) and Earnr IOS and Android mobile phone applications (known separately or together as the “Platform”)
By using the Platform, corresponding with Earnr over email, or being named within any application process, you acknowledge and agree you have had the opportunity to read and understand these Terms, and to be bound by these Terms.
Financial products arranged, promoted or managed by Earnr but not issued by Earnr, are issued by third parties as our product partners ("Partners", "Partner"), who have authorised us to provide you with access to those products.
If you use Earnr to access financial products issued by our Partners; you will be also bound by these terms to our Partner. You agree to have read and understood the relevant product disclosure statement (“PDS”) or product terms (“Product Terms”) issued at the time of your application for the product.. You agree to be bound by the Product Disclosure Statement, Product Terms and any supplementary product application terms contained in these Terms.
We may, at our sole discretion, vary or modify these Terms without prior notice. Any varied or modified Terms will appear on the Platform. Any subsequent access by you to the Platform or correspondence with us via email will constitute an acceptance of varied or modified Terms.
Personal information provided to us through the Platform or in any other form including email will be handled in accordance with our Privacy Policy. All information provided on the Platform is general only and does not take into consideration your particular investment objectives, financial circumstances or needs. You should always review the relevant PDS or Product Terms in full, and if you consider it appropriate obtain independent financial and tax advice.
In the event of any inconsistency in information between the Platform and the PDS relating to a financial product, the PDS will prevail.
To access our products and services via the Platform, you are required to register a user account ("User Account") using a valid email, mobile phone number and a secure password; and you become the holder of that User Account with Earnr.
You agree to provide true, accurate, current and complete information at all times while using the Platform including during registration of a User Account, the application for financial products, and your accounts maintained at third party websites. You agree not to misrepresent your identity, or your account information held with third party account providers.
You must not use a User Account held by any other individual to access products or services at any time.
You are responsible for the security of your password, and you agree to maintain the confidentiality of your password, at all times.
You agree to notify us immediately of any unauthorised use or any other breach of security in relation to your User Account.
You agree to use sms and / or email verification whenever required by Earnr to perform actions on your User Account or make changes to your User Account.
Unless and until you tell us that you believe that someone else knows your password or can use your User Account by impersonating you:
We can refuse to act on any instruction that we reasonably believe: (i) was unclear; (ii) was not given by you or an authorised person; (iii) might cause us to breach a legal or other duty; (iv) is connected to an illegal purpose.
Your User Account allows you to apply for products issued, arranged or promoted by Earnr; in various capacities.
You agree you have the authority to apply for a product in the capacity selected, and agree to apply in accordance with the following:
You agree that where you have provided information about another individual, you have made them aware of that fact, and the contents of our Privacy Policy.
You agree you are over 18 years of age and confirm you have read and understood the financial services guide (“FSG”),target market determination (“TMD”) and the PDS or Product Terms in relation to the product you are applying for, and confirm you understand the risks associated with the product.
You understand holding a User Account with Earnr does not guarantee the approval of a product applied for.
Earnr and our Partners are required by the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) Act 2006 to verify your identity before we can provide you with financial products and services. Electronic verification allows us to verify your identity by using electronic tools and external data sources.
To do this we or our Partners will collect details such as name, address, date of birth, and the details of your identification documents. We have arrangements with Equifax and RapidID who conduct matching processes on our behalf in order to complete the electronic identification. This is not a credit check or report and does not impact your credit file or credit eligibility.
In accordance with our Privacy Policy, you consent to us disclosing your personal information for the purpose of electronic identity verification.
You are approved for a product ("Approved", "Approval") in accordance with the relevant PDS or Product Terms.
For applications in the capacity of Partnership, Company, SMSF or Trust (Individual Trustee), SMSF or Trust (Corporate Trustee); we may contact individuals, partners and directors named in the application, in order to finalise the Approval.
Following an Approval, a legal account ("Legal Account") will be created, of type matching the capacity of the application, being: "Individual", "Joint", "Sole Trader ", "Partnership", "Company", "SMSF or Trust (Individual Trustee)", "SMSF or Trust (Company Trustee)".
Your User Account with Earnr provides you with electronic access to approved financial products, held in the Legal Account allocated.
Individuals, partners and directors who are a party of Legal Account types: Joint, Partnership, Company, SMSF or Trust (Individual Trustee), SMSF or Trust (Corporate Trustee); may gain electronic operational access to the Legal Account by registering their own User Account with Earnr.
You agree individuals, partners and directors who are a party of Legal Account types: Joint, Partnership, Company, SMSF or Trust (Individual Trustee), SMSF or Trust (Corporate Trustee); each become sole signatories in relation to the Legal Account, as such can independently provide operational instructions (including withdrawals) in relation to products held(upon satisfaction of verification requirements), binding other individuals, the partnership, company or trust.
In some circumstances we may allow you to appoint a representative to operate the Legal Account manually, or electronically by registering a User Account with Earnr; under an authorised representative document. This request can be made by contacting Earnr at hello@earnr.com.au.
Earnr is a digital first company – to the extent possible we carry out all business electronically in accordance with the Electronic Transactions Act 1999. This includes registering a User Account and Legal Account, financial product approval, transacting & account operation, and general and product related communication.
You consent to using electronic means to agree to and bind you to, legal obligations. Where you indicate through electronic means your agreement to, or acceptance of; terms and conditions, offers and other documents – you will be taken to have legally agreed to them, or signed them. This includes terms and conditions, offers and other documents issued by our Partners.
In accordance with the Electronic Transactions Act 1999 you agree that a requirement by you to give information in writing, produce a document, or provide a signature; is taken to have been met by means of electronic communication.
You consent to receive any and all notifications, documentation and information that we or our Partners are required to provide to you, by electronic communication. Notwithstanding this consent, we or our Partners may still decide to send you paper copies in certain circumstances.
You must regularly check your text messages, email and User Account for documents including statements, disclosures, notices and other correspondence, and agree to receive these in electronic form.
You agree to use the Platform only as outlined, per these Terms, and not for any unlawful purpose.

We do not warrant or guarantee the accuracy, copyright compliance, regulatory compliance, legality, or any other aspect of third party material on our Platform or on third party websites; nor do we accept responsibility or liability for the above.
To the extent permitted by the law, Earnr, our affiliates and our Partners (including respective employees, agents or officers); do not accept any liability for any loss or damage, howsoever arising, which you or any third party may suffer directly or indirectly in connection with the Platform. This includes (but is not limited to) loss or damage arising from:
To the extent permitted by the law, you must indemnify us against any liability suffered or incurred by us, or arising in connection with your use of our Platform; or any breach of these Terms and our agreement. This is a continuing obligation and continues after our agreement ends.
We may assign or novate this agreement to another party providing that party undertakes to perform all of our obligations in this agreement. You may only assign or novate any of your obligations under this agreement with our written consent.
We, or our Partners may assign or novate your interest or holding in a financial product to another product issuer or fund of existing issuer, providing the PDS or Product Terms are identical, and the obligations to you regarding the product continue to be fulfilled.
All material and content on our Platform, including these Terms, is copyright protected. This includes our associated layout, design and operating structure. No aspect of this may be copied, reproduced, broadcast, adapted, or transmitted; in any form, without our prior written consent.
Earnr is a trademark owned by us. You are prohibited from using this trademark and logos owned by us, in any form, without our prior written consent.
Your access to the Platform may be suspended or terminated at any time without notice, so long as we or our partners fulfil any obligations to you outlined in the relevant PDS or Product Terms, with regards to products held.
